We may gather and use certain information about individuals related to your project, e.g domestic and commercial garden designers, developers, landscape architects, landscape contractors, suppliers, business contacts, contractors, employees and other people with whom we have a relationship or may need to contact in the course of conducting our business with you; however, we will not release any information to others without your express premission.

  • Plans, proposals, technical designs and drawings; photograhic images; property, garden or landscape dimensions, design specifications; surveys, delivery schedules and quotations;

  • Property location information, e.g. to facilitate delivery of goods and related services.

 

Details and specifications of your preferences and product specifications, e.g. types of samples/products/materials, such as:

  • Material samples, such as wood, stone, gravel, ironmongery or other hardware;

  • Garden furniture, design accessories and reclaimed products or similar materials;

  • Garden architecture, such as hardwood trelliswork, landscape structures and bespoke garden features, including benches, pergolas, gazebos, timber etc.;

  • Ironmongery, such as gates, railings, cattle and dog grids; structures such as pergolas and arched walkways; sculptures;

  • Garden lighting and irrigation;

  • Routes for delivery and installation;

  • Associated financial records, e.g. purchase orders, delivery notes and invoices.

 

As required by law, we store data for the statutory minimum periods required: typically a maximum seven years from project start date.

 

We receive, collect and store any information you enter on our website or provide us in any other way.  We may collect the Internet protocol (IP) address your computer uses to connect with the Internet, for example: login details; e-mail address; password; computer and connection information and purchase history, as applicable.

 

We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.  

 

We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, reviews, recommendations, and personal profile.

When you make an enquiry via our website, or as part of our sales process, or subscribe to a mailing list, we collect any personal information you provide, e.g. your name, address, email address and telephone number.

We use your personal information to supply you with samples, quotations, products, designs, materials and other products or services you have requested.  We use these details to understand your needs, furnish you with product or supplier information you may require and how we can continually improve the services we provide.

2. To make appointments and discuss your project details;

3. To share project-related information that you require;

We keep your contact information and details of your project securely on file so we can continue to offer you assistance and after-care in the future, unless you ask us not to.  Only senior management can access your information.

 

How we store, use, share and disclose site visitors' personal information

Upcher & Co. is committed to storing all personal data securely.  We do not share your personal data with third parties without first seeking your permission.  Subject to receiving your permission, we may share the following information with third parties, e.g. delivery agents, contractors and suppliers:-

To prevent unauthorised access or disclosure, we adhere to appropriate physical, electronic and managerial procedures, including password protection and locked storage to safeguard and secure any information we collect, whether paper or online. 

 

We store both current and archived paper and hard copy documentation securely in locked facilities only accessible by management.

We acknowledge our obligation to comply with GDPR and have the necessary control measures in place for the safe and secure management of the data we collect.

 

How we communicate with our site visitors

We may contact you to discuss your project, deliveries, resolve a dispute, collect fees or monies owed or to send important updates about Upcher & Co., or as otherwise necessary to enforce our User Agreement, subject to applicable national laws and any agreement we may have with you.  For these purposes we may contact you via email, telephone, text messages, or postal mail.

We use the personal information you provide to supply you with quotations, designs, samples, products, materials and other items or services you have requested from us.  We also use these details to understand our clients and how we can continually improve our services and products.

We may pass on your data to our subcontractors so they can carry out services you have requested, such as the delivery of requested samples or your products.  We never share your data for others to use for their marketing communications.

Our website and servers use RapidSSL SSLCertificates to offer secure communications by encrypting all data to and from the site and storage on our servers.  RapidSSL has checked and verified the site's registered domain name.  No one can read or access data transmitted.

However, the transmission of information via the internet is not totally secure, so such information could be intercepted.  As we cannot guarantee the security of data you choose to send us electronically, sending such information is entirely at your own risk.

 

How long we keep your data

Upcher & Co. stores data for a period of up to seven years to allow provision of continued client support following completion of your project.  We record and store all purchases, installations and works completed against a client’s record for as long as required to fulfil projects and contracts.  We delete personal data for clients who have not utilised our services after seven years.

 

Disclosing Your Information

We will not disclose your personal information to any other party other than in accordance with this Privacy Policy and in the circumstances detailed below:

* In the event that we sell any or all of our business to the buyer.

* Where we are legally required by law to disclose your personal information.
